Heyday is a social media app for US-based users who are 18 y.o. or older.

Heyday users can create or join groups and channels to find and meet like-minded people who share their interests and passions by chatting and sharing images and videos.

Heyday is operated by California-based company Apollo Evolution, Inc. and is available to download for free on the App Store for iOS users.

👮‍♀️ Heyday Law Enforcement Guidelines

The safety of Heyday users and the integrity of the community is the main priority for Apollo Evolution, Inc. We are open to collaborating with law enforcement and governmental agencies to promote and enhance safety on our platform. Heyday is strictly open to 18 or older users, which is reflected in our House Rules (Community Guidelines) and is enforced with the help of AI detection and human moderators.

Heyday is fully committed to assisting law enforcement in their requests while respecting the privacy and rights of our users. Once we confirm the validity of a legal request for Heyday user profile records, we will respond in compliance with applicable law and privacy requirements.

🧑‍⚖️ Legal Framework

These operational guidelines are provided for law enforcement officers, governmental agencies, and court officials seeking to request Heyday user account records (i.e., Heyday user data).

Apollo Evolution, Inc. will not respond to requests for information by private parties, such as civil litigants, non-governmental organizations, or researchers unless they are in the context of an official legal process.

🗽 U.S. Legal Process

As a U.S. company, Apollo Evolution, Inc. will disclose user data in accordance with U.S. laws and as indicated by its Terms of Service and Privacy Policy.

Our ability to disclose Heyday account records is generally governed by the Stored Communications Act, 18 U.S.C. § 2701, et seq. The SCA mandates that we disclose certain Heyday account records only in response to specific types of legal processes, including subpoenas, court orders, and search warrants.

🌐 Non-U.S. Legal Process

Law enforcement organizations from outside the United States must rely on a Mutual Legal Assistance Treaty (MLAT) or letter rogatory through the proper legal authorities in their own country to obtain any Heyday user data. Apollo Evolution, Inc. reserves the right to review these requests on a case-by-case basis.

💽 Data Retention

Apollo Evolution, Inc. collects and stores user information in accordance with its Terms of Service and Privacy Policy. This includes the user's first and last name, email, phone number, address, cookies, and usage data.

All data is retained according to applicable law and for as long as needed to allow users to use Heyday. According to the Privacy Policy, users are allowed to access their data by contacting help@heyday.net. As per the California Consumer Privacy Act, the residents of California are allowed to request to know what data are collected about them and exercise the right for it to be removed.

🆘 Emergency Disclosure Requests

If someone is at risk of imminent harm, such as death or serious physical injury, we may voluntarily disclose Heyday account records consistent with 18 U.S.C. §§ 2702(b)(8) and 2702(c)(4), when we believe in good faith that the immediate disclosure of such records is required.

Emergency Disclosure Requests to Apollo Evolution, Inc. must be submitted by a sworn law enforcement official and must come from an official law enforcement (or governmental) email domain. We reserve the right to review these requests on a case-by-case basis.

⏳ Preservation Requests

We honor formal requests from law enforcement to preserve information in accordance with 18 U.S.C. § 2703(f). Apollo Evolution, Inc. will preserve account records for up to 90 days once a valid preservation request is received. With a formal extension request, we will extend the preservation for an additional 90-day period.

🚼 Child Safety

In cases where Heyday was made aware of potential child exploitation and abuse material on the platform, our Trust and Safety team reviews the allegations and, if confirmed, reports directly to the National Center for Missing and Exploited Children (NCMEC). NCMEC reviews those reports and coordinates with both global and local law enforcement agencies.

🔔 User Notification

Apollo Evolution, Inc. notifies Heyday users when the legal process seeking disclosure of their records is received. We recognize two exceptions to our policy:

  • it is prohibited by court order as it might jeopardize the investigation;
  • at our sole discretion, we determine that the circumstances of the situation require non-disclosure.
